This Youshare Safe Harbor and Repeat Infringers Policy ("Policy") states the policy of Youshare, Inc., doing business as Youshare ("Youshare"), for repeat copyright infringement and its separate authority to address serious or repeated violations of other Youshare rules. It supplements the Youshare Terms. Capitalized terms not defined here have the meanings in the Youshare Terms.

1. Scope

This Policy applies to subscribers, Account holders, Accounts, and use of Youshare.com and the Platform.

2. Repeat Copyright Infringement

Youshare maintains a policy of terminating repeat copyright infringers in appropriate circumstances.

No fixed number of notices, removals, warnings, or "strikes" alone determines whether termination is appropriate, and no threshold guarantees continued access. Nothing in this Policy limits Youshare's authority to remove or restrict Content, suspend access, or take other action based on a single matter under the Youshare Terms, Section 3 of the Youshare Intellectual Property Policy, another applicable Youshare document, or law.

3. Standard Technical Measures and Monitoring

Youshare accommodates and does not interfere with standard technical measures that qualify under 17 U.S.C. Section 512(i). Nothing in this Policy creates a general duty to monitor the Platform or affirmatively seek facts indicating infringement, except to the extent consistent with a qualifying standard technical measure or otherwise required by applicable law.

4. Other Serious or Repeated Violations

Repeat copyright infringement is distinct from serious or repeated violations of other Youshare rules. Youshare may address those violations under the Youshare Terms and the document governing the conduct, including by restricting, suspending, or terminating an Account or Platform activity. A single material violation may result in immediate action where appropriate and legally permitted.

Other violations do not become copyright infringement merely because they repeat. Reports concerning non-copyright rights or other Youshare rules are not automatically treated as copyright notices or "strikes."

5. Relationship to Other Youshare Terms

Mandatory applicable law controls first. This Policy governs repeat copyright infringement and distinguishes it from serious or repeated violations of other Youshare rules. Section 3 of the Youshare Intellectual Property Policy governs copyright notices and counter-notices. The Youshare Acceptable Use Policy and other applicable Youshare documents govern the underlying conduct. Youshare Privacy governs Youshare's processing of Personal Information.

The Youshare Terms govern the Platform generally, the contractual relationship, document hierarchy, and matters this Policy does not address. Subject to mandatory law, a more specific Youshare document controls only the subject it expressly addresses.
